Welcome to HKCMarket. These terms are an agreement between you and us. By using the site, you agree to them. We've kept them as plain as we can; if anything's unclear, email hello@hkcmarket.com.
1. Your account
You need an account (created automatically when you sign in with a magic link) to purchase or claim files, leave ratings, or access your downloads. You're responsible for keeping your email secure. Anyone with access to your email can sign into your account.
2. Purchasing digital downloads
When you buy a file, you receive a non-exclusive, non-transferable license to use that file for personal crafting projects. Key points:
- Personal use is always permitted: make cards, scrapbook pages, home decor, gifts for yourself, family, and friends.
- Small-scale commercial use is permitted: sell finished physical crafts (cards, layouts, decor) at craft fairs, online shops, etc. Attribution isn't required but is appreciated.
- You may not redistribute, resell, or share the digital file itself.
- You may not use our files to create new digital products to sell (SVG bundles, digital planners, sticker packs, etc.).
- You may not use our files for mass production beyond reasonable craft-fair scale. For large-scale commercial licensing, email hello@hkcmarket.com.
Files remain the copyrighted work of HKCMarket and the original designer.
3. Payment
Prices are shown in US dollars. Payment is processed by Stripe. Your card is charged immediately on purchase. Downloads are delivered instantly via a time-limited link (48 hours by default; re-downloadable from your account for the life of your account).
4. If something isn't right
We don't issue cash refunds on digital downloads. Once a file leaves our servers it can't be "given back." What we do instead: replace the file or credit your account, your choice. Full details in our Digital Goods Promise. Situations covered include corrupt files, wrong file delivered, duplicate purchases, and anything else that feels off. Just ask.
5. Free files and points
Some files are marked "Free" and can be claimed without payment. Free file limits apply per account (typically 5 per new user; see your account page for your current limit).
If you participate in our points program (future feature), points you earn or purchase are not cash. Points have no monetary value outside HKCMarketand are not transferable or redeemable for cash.
6. Acceptable use
You agree not to:
- Attempt to bypass payment, share your account, or circumvent access controls
- Scrape, crawl, or harvest data from the site beyond normal browsing
- Upload or submit content that's illegal, harassing, infringing, or malicious
- Use the site to transmit malware, spam, or to attack other services
- Impersonate anyone or misrepresent your identity
- Use automated means to rate content, post comments, or otherwise manipulate community features
We may suspend or terminate accounts that violate these terms. If we do, you'll lose access to your account and any unredeemed points; purchased download history is preserved so you can still download what you paid for.
7. User-submitted content
When you submit content (reviews, UGC, tutorials, collections - when those features ship), you grant HKCMarketa non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content in connection with the service. You retain ownership of what you submit. You're responsible for ensuring you have the right to submit anything you do.
8. Intellectual property
The HKCMarket name, logo, branding, and original site content are our intellectual property. Digital files offered for sale are the property of their creators; your purchase grants a license, not ownership.
9. Third-party links
Tutorials and blog posts may include affiliate links to third-party products (craft supplies, tools). We may earn a commission when you purchase through those links. We only recommend products we'd use ourselves. Third-party sites have their own terms and policies.
10. Disclaimers
The service is provided "as is." We don't promise the site will be uninterrupted or error-free. We make no warranty that files are compatible with every cutting machine or software, though we work hard to ensure they are.
11. Limitation of liability
To the maximum extent permitted by law, HKCMarket is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold HKCMarket harmless from claims arising from your violation of these terms, your misuse of the service, or your infringement of third-party rights.
13. Changes
We may update these terms. If we make material changes, we'll email registered users and post the updated version here. Your continued use of the site after changes means you accept the new terms.
14. Governing law
These terms are governed by the laws of the United States and the state where HKCMarket is operated, without regard to conflict-of-law principles. Disputes are resolved in the courts of that state.
